Effective from <date>. Version 1.

1. Operator

The Snapisodes app ("the app") is operated by ("the operator", "we"):

• ConsultX s.r.o.

• IČO 08973288
• <VAT ID, if VAT registered>
• <entry in the Commercial Register / Trade Register>
• e-mail: support@consultx.cz

• website: https://snapisodes.cz

We answer questions and complaints within 3 business days.

2. Scope

1. These terms govern the use of the Snapisodes app for Android (free version, trial and the paid Snapisodes Pro) and the purchase of Pro. If you use the app as a consumer, you also have all rights granted to you by law; nothing in these terms limits them.
2. You install the app and buy Pro through Google Play. The Google Play Terms of Service also apply to the installation, the payment and your Google account. Google processes the payment: for buyers in the Czech Republic and the European Economic Area the merchant of record is Google Commerce Limited (Ireland), which handles the sale on behalf of the operator, collects the price, remits VAT and issues refunds under the Google Play rules. The operator is responsible to you for the app and Pro, their features, updates and defects.
3. The app has no server of its own and no user account with the operator. The contract is concluded only through Google Play and creates no account with us.

3. Free version and trial

1. The app is free to download. For the first 14 days after the first installation all Pro features are available free of charge (trial). The trial does not restart after clearing data or reinstalling, and nothing is charged when it ends; there is no subscription.
2. After the trial the following, among others, stay free: gallery, map, search, backups, XMP export, dictation, episode story as an image, episode description, episode suggestions, temporary photos and the widget. In the free version you can create 3 new episodes and comment on 20 new photos per calendar month; a comment can have at most 20 characters.
3. Nothing you created in the free version or during the trial disappears when it ends; above the limit you only cannot add further episodes and comments.
4. We may change the scope of the free version in later versions of the app (section 10). We will not reduce a Pro you have already bought.

4. Snapisodes Pro

1. What Pro is. A one-time paid unlock of app features (digital content not supplied on a tangible medium): no limit on episodes and commented photos, comments longer than 20 characters, merging episodes, photo book (PDF and ZIP), episode story as PDF, automatic episodes from GPS and deleting from OneDrive as well. The current description is in the app's Pro screen and in the Google Play listing.
2. Price. The price is shown in Google Play and in the Pro screen before the purchase (CZK 249 in Czechia, EUR 9.99 in the euro area, converted by Google Play elsewhere) and is final, VAT included. Pro is a one-time purchase, not a subscription; nothing renews or is charged again. Any promotional price is always marked in Google Play.
3. Conclusion of the contract. The contract for Pro is concluded when you confirm the purchase in the Google Play payment dialog. Google sends the order confirmation to the e-mail address of your Google account.
4. Supply. Pro is unlocked immediately after the payment is confirmed. A pending payment (e.g. cash or bank transfer, where Google Play offers it) unlocks Pro once it is completed.
5. Google account. Pro is linked to the Google account used for the purchase and works on all your Android devices signed in with that account. After reinstalling or on a new phone, restore it in the Pro screen with Restore purchase.
6. Technical requirements. A phone or tablet with Android 8.0 or later and Google Play. Some features need an internet connection (map, place name suggestions, OneDrive) or optional services (Health Connect, a Microsoft account). Pro cannot be bought on devices without Google Play services.

5. Right of withdrawal (14 days) and refunds

1. As a consumer you may withdraw from a distance contract within 14 days of its conclusion without giving a reason (§ 1829(1) Czech Civil Code).
2. Loss of the right of withdrawal. For digital content not supplied on a tangible medium, this right lapses once performance has begun, provided that before the purchase you expressly consented to Pro being supplied before the withdrawal period ends, acknowledged that you thereby lose the right of withdrawal, and received a confirmation on a durable medium (§ 1837(l) and § 1824a(2) Czech Civil Code, Art. 16(m) Directive 2011/83/EU). This consent and acknowledgement are part of the Google Play purchase dialog <and of the app's Pro screen – after the app is updated>; the confirmation is in the order confirmation e-mail.
3. If these conditions were not met, you may withdraw within 14 days of the purchase by a clear statement sent to support@consultx.cz (you may use the model form in Annex A), quoting the Google Play order number (starting with "GPA."). We refund the price without undue delay and at the latest within 14 days of receiving the withdrawal, using the same means of payment (refunds are issued through Google Play). After withdrawal Pro is locked again in the app; your data remain.
4. Refunds through Google Play. Within 48 hours of the purchase you can ask Google Play directly for a refund (play.google.com → Payments & subscriptions → Budget & order history → Report a problem). Google decides under its own rules; your statutory rights are not affected. After 48 hours, contact us.
5. <Optional, owner's decision (open point 6): Beyond the law, on request sent within 14 days of the purchase we refund the price of Pro even if the right of withdrawal has lapsed.>

6. Defects and updates (conformity of digital content)

1. We are responsible for the app and Pro having the features described in the Pro screen and the listing, being fit for their usual purpose and matching what can reasonably be expected of an app of this kind (§ 2389i Czech Civil Code).
2. Updates. We provide the updates needed to keep the app and Pro free of defects (including security updates) for the period you can reasonably expect, and at least <2 years> from the purchase of Pro (§ 2389d and § 2389f(4)). Updates arrive through Google Play with release notes for every version. If you do not install a recommended update within a reasonable time, you have no rights for a defect caused solely by that (§ 2389d(3)), unless we failed to inform you of the update and the consequences of not installing it.
3. Period. You may report a defect within 2 years of Pro being supplied (§ 2389k(1)). A defect that appears within one year is presumed to have existed at the time of supply (§ 2389f(3)).
4. How to report. Write to support@consultx.cz: what does not work, phone model and Android version, app version (Settings → About), order number. The file from Settings → Send diagnostics helps (nothing is sent automatically; you see the content; it contains no photos, file names, places or comments). We confirm the complaint and handle it without undue delay, at the latest within 30 days (§ 19 Czech Consumer Protection Act).
5. Your rights. You may ask for the defect to be removed. If we do not remove it, it appears again, or it is a material breach, you may ask for a reasonable price reduction or withdraw from the contract (§ 2389l, § 2389m); withdrawal is not possible for a minor defect. We refund money within 14 days (§ 2389p).
6. Environment. We are not liable for a defect if we prove it was caused by an unsuitable device, system or connection about whose requirement you were informed before the purchase (section 4.6, § 2389e(2)). Features depending on third-party services (Google Play, the system speech recognition service, place search, OpenStreetMap map tiles, OneDrive, Health Connect) may change or stop working without our will; in that case we replace them where possible, or section 6.5 applies.

7. Licence and rules of use

1. We grant you a non-exclusive, non-transferable licence to use the app (and, after buying Pro, its features) for your own needs on devices signed in with your Google account, for the duration of the contract. The app contains third-party components under their own licences (list in the app: Settings → About → Licences and sources).
2. You must not use the app to infringe the rights of others, circumvent the purchase protection or resell it.
3. Your content stays yours. Photos, videos, episode names and comments are yours; we obtain no rights to them and have no access to them (section 8).

8. Your data, privacy and backups

1. How the app handles data is described in the Privacy Policy: https://snapisodes.cz/en/privacy/ (Czech: https://snapisodes.cz/cs/privacy/). The app has no server of its own; photos and comments stay on your phone and in the backups you choose.
2. What the app does with your photos. It keeps episodes and comments in its database on the phone. For JPEG photos it also writes them into the photo file, only into the descriptive data part (XMP): the image, the EXIF data (including the GPS location) and the other parts of the file do not change. You can switch writing into files off at any time (consent screen, Settings). The only other change of a file is rotating a photo at your request, which changes only the orientation value. Files for which writing would be risky (HEIC, PNG, videos and photos with several images in one file, e.g. Ultra HDR) are never rewritten; their episodes and comments stay in the database only.
3. The app's safeguards (so you know what to expect):
   • Before each rewrite of a photo the app verifies that nothing but the XMP part of the file changes, keeps a backup copy of the original file and writes a write journal. After writing it reads the file back and compares it; on any difference it restores the original content. If a crash or the phone switching off interrupts the write, the app restores the original file at the next start using the journal, or saves it as a new photo with "_recovered" in its name.
   • On Android 11 and later a deleted photo goes to the system trash, where it stays for 30 days and from where you can restore it in the app together with its episode and comment. The app deletes a photo permanently (emptying the trash, or on Android 8 to 10, which have no system trash) only after your explicit confirmation.
   • Deleting from OneDrive as well (Pro) works only when you switch it on yourself, and only for photos deleted in the app and only for their copies with identical content in the chosen folder. It happens only after a waiting period (7 days by default) and the copy goes to the OneDrive recycle bin; the app never deletes anything from OneDrive permanently.
   • The app regularly saves a backup file of episodes and comments to Downloads/Snapisodes/Backup. It does not back up the photos themselves.

The safeguards greatly reduce the risk, but no software can rule out data loss completely (for example a fault of the phone's storage or another app acting on the files). This description matches the version of the app current on the effective date of these terms.

4. Back up your photos. The app is not a photo backup service. Before you first use the app, and then regularly, back up your photos and videos outside the phone, for example to Google Photos, OneDrive or a computer, and check from time to time that the backup works. A backup also protects you against losing or damaging the phone, which has nothing to do with the app. If your photos are not backed up, section 9.4 applies.
5. Temporary photos (a feature you use yourself) are stored only in the app, not in the gallery or in any backup, and are deleted after the period you choose without a way to restore them. Keep a photo you want by tapping Save to gallery.

9. Liability

1. We are liable for damage under the Czech Civil Code. We never exclude or limit liability for harm to a person's natural rights (for example health) or for harm caused intentionally or by gross negligence (§ 2898 Czech Civil Code).
2. If you are a consumer, these terms neither exclude nor limit your statutory rights to compensation or your rights for defects; the limitation in point 3 does not apply to you. Points 4 and 5 apply to you as well.
3. Limit of compensation (business users). If you use the app as a business for your business activity, our liability to you for damage other than under point 1 is limited to the price you actually paid for Pro. For the free version and the trial, for which you paid nothing, we are not liable to you for damage caused by slight negligence only.
4. Data lost without a backup. Backing up photos (section 8.4) is the ordinary care that can be expected when handling photos. If you lose photos or other data that you had not backed up, this is attributable to you and the duty to compensate the damage is reduced proportionately under § 2918 Czech Civil Code.
5. We are not liable for outages and changes of third-party services under section 6.6 that we did not cause, nor for loss of data caused by another app, the system or the user acting on files outside the app; your statutory rights for defects are not affected.

10. Changes to the app and to these terms

1. We keep developing the app. A change that is not needed to remove a defect is made only for a valid reason (e.g. a new Android version, a change of a third-party service, security, a new feature), without extra cost for you and with clear notice in the release notes (§ 2389q Czech Civil Code). If a change would more than minorly impair your access to or use of Pro, we notify you in the app in advance and you may terminate the contract free of charge within 30 days with a pro-rata refund, or we let you keep using Pro unchanged.
2. We may change these terms for a serious reason (change of law, change of Google Play, new features). We publish the new version on the website with its effective date at least 30 days in advance and, after the app is updated, ask you in the app for your consent again (section 13.2). A change never reduces the features of a Pro you have already bought. If you disagree, you may stop using the app and terminate the contract; until you accept the new version, the app writes nothing into photo files and deletes nothing.

11. Complaints and out-of-court dispute resolution

1. We handle complaints at support@consultx.cz, usually within 3 business days, at the latest within 30 days.
2. Out-of-court resolution. Consumers have the right to out-of-court resolution of disputes arising from the contract. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), ADR department, Štěpánská 567/15, 120 00 Prague 2, https://adr.coi.cz. A proposal can be filed within 1 year of the day you first raised your claim with us.
3. Consumers from another EU state, Iceland or Norway may also contact the European Consumer Centre Czech Republic (https://www.evropskyspotrebitel.cz), which helps with cross-border disputes.
4. The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025; disputes can no longer be handled through it.
5. Supervision. Consumer obligations are supervised by the Czech Trade Inspection Authority (https://coi.gov.cz), the processing of personal data by the Office for Personal Data Protection (www.uoou.cz). The operator does business under the authorisation given in section 1; trade supervision is exercised by the competent trade licensing office.

12. Governing law, courts and language

1. The contract is governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection. If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Art. 6(2) Rome I Regulation).
2. A consumer may sue in the Member State of their domicile or in the Czech Republic (Art. 18 Brussels I bis Regulation).
3. If any provision is invalid, the others remain in force.
4. These terms are binding in Czech and in English; in case of conflict the Czech version prevails.

13. Effective date and consent

1. These terms take effect on <date> in version 1.
2. Consent in the app. At the first start of the app, and for earlier users once after the update that introduces it, the app shows a screen with a link to these terms; you give your consent with Agree and continue. The app stores on the phone the version of the terms you agreed to and the time of your consent (it sends them nowhere). Until you agree, the app writes nothing into photo files and deletes nothing. A new version of the terms requires a new consent.
3. You also confirm the purchase of Pro in the Google Play purchase dialog (section 4.3).
4. We will send you earlier versions of these terms by e-mail on request.
